JUSTICE ARUN KUMAR ORAL ORDER 23-02-2017 Heard learned counsel for the petitioner and the State. Petitioner seeks bail in Kiul Rail P.S. Case No.14 of 2017 registered under Sections 30 (A), 38 (1) of Bihar Excise (Amendment) Act, 2016.

Allegation in brief is that police apprehended the petitioner from general bogy of the train.

Submission is that petitioner was a passenger as he was travelling in general bogy; merely on suspicion apprehended by the police but nothing was recovered from his possession. He has got no criminal antecedent and has been in custody since 20.1.2017.

Having considered the said facts and circumstances, let the petitioner, namely, Rahul Kumar be released on bail on
