JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-04-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 498A, 341, 323 and 34 of the Indian Penal Code.

Allegation against the petitioner, who is husband of the informant, is that he along with other in-laws assaulted and tortured informant and also pushed her from vehicle on GayaRajauli Main Road near Fatehpur Bajarangbali Temple. Heard learned counsel for the petitioner.

It has been submitted on behalf of the petitioner that he is ready to keep her with him. He has also filed a petition under Section 9 of the Hindu Marriage Act for restitution of conjugal life in the Family Court at Nawada.

Heard learned A.P.P. also.

Patna High Court Cr.Misc. No.16750 of 2017 (2) dt.17-04-2017 2/2 Having heard both sides, in view of the allegation made, I am not inclined to grant anticipatory bail to the petitioner, the same is rejected.

However, petitioner may surrender in the court below, i.e., learned C.J.M., Gaya, in connection with Fatehpur P. S. Case no. 235 of 2016 and make prayer for regular bail which will be considered on its own merit without being prejudiced by the order of this Court.
