Learned counsel for the petitioner submits that the benefits on account of Assured Career Progression are being denied to the petitioner due to non passing of the departmental examination. He has drawn attention of the Court and raised a grievance that his claim for exemption from passing the departmental examination under the extant provision has been made before the District Magistrate, Gaya (respondent no.4) by application dated 22.10.2015 (Annexure 8). In view of the limited grievance, writ petition is disposed of with a direction to respondent no.4 to dispose of the claim of the petitioner dated 22.10.2015 (Annexure 8) by a reasoned and speaking order in accordance with law within a period of three months from the date of receipt/production of a copy of this order.
