JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Mufassil P.S. Case No. 313 of 2007 registered for the offences punishable under Sections 366, 498 of the Indian Penal Code. Admittedly, victim has returned to her home safely and her statement under Section 164 of the Cr.P.C. was recorded. No doubt, she stated in her statement that she was taken to Dehradun by the petitioner but she admitted that the petitioner left her at Dehradun and after that she returned to her home. Furthermore, the victim has admitted that she was not ill treated by the petitioner while she was confined by him in a room. The contention on behalf of the petitioner is that there
Patna High Court Cr.Misc. No.10754 of 2015 (2) dt.19-03-2015 was love affair between petitioner and victim and as a matter of fact, victim herself eloped with the petitioner. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Deopriya Kumar, Judicial Magistrate 1st Class, Begusarai in Mufassil P.S. Case No. 313 of 2007 subject to condition as laid down under Section 438(2) of the Cr.P.C.
