The petitioner seeks bail in a case instituted under Sections 419, 420, 467, 468, 471, 147, 149, 353, 332, 334 and 307 of the Indian Penal Code and Section 3/4 of the Damage to Public Property Act.
It is alleged that on secret information about the mischievous act of brokers at the electrical shop of Ashok Kumar Sharma, the informant raided at his house and several registers of different schemes, list of beneficiaries, different application forms etc. are said to have been recovered from the shop. It is further alleged that when the co-accused raised alarm, more than 100 people gathered there and made protest to the official acts of the
Patna High Court Cr.Misc. No.8383 of 2017 (2) dt.09-03-2017 2/2 informant and damaged the government vehicle. It has been submitted on behalf of the petitioner that the petitioner is in custody since 21.11.2016. The charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. There is no specific overt act has been alleged against the petitioner. The other co-accused has been granted bail vide Cr. Misc. No.6272 of 2017. On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Khagaria in connection with Parwatta P.S.
