The petitioner seeks bail in Kadamkuan P.S. case No. 394 of 2016 under Section 25 (1-b), 26 of the Arms Act and under Section 53 of the Bihar Excise (Amendment) Act, 2016. One country made loaded pistol and one live cartridge were recovered from the possession of the petitioner and for that the petitioner is in jail since 28.09.2016. The learned counsel for the petitioner submits that, of course, five criminal cases are pending against him but in Alamganj P.S. case No. 181 of 2016 the petitioner was remanded later on after being remanded in the present case. The petitioner is on bail in all these cases.

Considering the facts that petitioner has already

Patna High Court Cr.Misc. No.14944 of 2017 (3) dt.19-05-2017 2/2 remained in jail for 7 1⁄2 months for recovery of one loaded country made pistol and one live cartridge, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Om Prakash VI, learned Additional Chief Judicial Magistrate-VII, Patna in Kadamkuan P.S. Case No. 394 of 2016.
