ANJANA MISHRA ORAL ORDER 19-05-2016 Heard learned counsel for the petitioner and the learned counsel for the complainant-informant as well as the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Kharagpur P.S. Case No.5 of 2015 for allegedly having committed the offence under Sections 467, 468, 471, 409, 420, 120B/34 of the Indian Penal Code. Learned counsel for the petitioner submits that out and out a frivolous complaint has been lodged against the petitioner. It is further submitted that none of the officials of Nagar Panchayat, Kharagpur has lodged any complaint; rather the complainant, being an outsider, has for reasons best known to himself and from the information gathered from extraneous

Having heard learned counsel for the parties and on perusal of the case diary, I do not find that a prima facie case is made out against the petitioner. As such, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Munger, in connection with Kharagpur P.S. Case No.5 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
