The petitioner apprehends his arrest in a case registered for the offence punishable u/s 304, 506, 34 of the IPC. Allegedly, the wife of the informant has been assaulted by the petitioner, who died in course of treatment. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. It is submitted that the petitioner has admitted the wife of the informant in the P.M.C.H. and she died in course of treatment. Petitioner has no criminal antecedent.
Learned APP for the State opposed the prayer for bail by
Patna High Court CR. MISC. No.13832 of 2023(2) dt.29-04-2023 2/2 submitting that there is allegation against the petitioner to give repeated blow, due to which, she sustained serious injuries and died in course of treatment.
Having regard to the facts and circumstances of the case and considering the nature of allegation, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on behalf of the petitioner named above is hereby rejected.
This application is accordingly dismissed.
However, petitioner is at liberty to surrender before the learned Court below within a period of six weeks from today and seek regular bail and the learned Court below would pass order, preferably, on the same day, in accordance with law. (Anjani Kumar Sharan, J) pallavi/- U T
