JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 03-01-2022 Let the defects, if any be removed within four weeks of the complete start of the physical Court. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Learned counsel for the petitioner submits that petitioner no. 1, Mashudan Yadav has already been arrested. Accordingly, application of petitioner no. 1 is dismissed as withdrawn.

Petitioner apprehends his arrest in connection with Masaurhi P.S.Case No. 501 of 2020 registered for the offences punishable under Sections 323, 341, 324, 307, 379, 354, 427, 448, 504/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that there is case and counter case between the parties. Specific allegation of assault is against co-accused Mashudan Yadan. It appears from the impugned order that inuries are simple in nature. Learned APP for the State has opposed the prayer for anticipatory bail of the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, it is ordered that petitioner no. 2 Upendra Yadav @ Upendra Prasad, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Masaurhi, Patna in Masaurhi P.S.Case No. 501 of 20 subject to condition as laid down under Section 438(2) of the Cr.P.C.
