The petitioners seek regular bail in connection with Delha P.S. Case No. 172 of 2016, registered for offences punishable under Sections 399 & 402 of the Indian Penal Code and Sections 25(1-B)A/26/35 of the Arms Act.

It has been submitted on behalf of the petitioners that nothing has been recovered from the possession of the petitioners and they are in custody since 2.10.2016. It has also been submitted that though the petitioners are accused in one case each but they are on bail in those cases.

Heard learned A.P.P. also.

Having heard both sides and in view of the fact that there is no recovery from the petitioners and they have

No.16095 of 2017 (2) dt.08-04-2017 2/2 remained in custody for about six months, let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of A.C.J.M.-VII, Gaya in connection with Delha P.S. Case No. 172 of 2016 with the following conditions:

(i) One of the bailors of the petitioners shall be a close relation having sufficient immovable property within the jurisdiction of the concerned court. (iii) If the petitioners are found involved in any similar type of cases in future, their bail bonds shall be liable to be cancelled.

With the aforesaid observation, this application is allowed.
