2. This is the second attempt of the petitioner for grant of regular bail in connection with Jagdishpur P.S. Case No. 291 of 2024 registered for the offence under Sections 103,238, 61(2), 3(5) of the BNS. Earlier the bail application of the petitioner was rejected vide order dated 23.07.2025 passed in Cr. Misc. No. 17524 of 2025.

3. As per the prosecution case, the deceased Ankit Aditya was called by one Narendra Singh @ Fantoosh and others, thereafter, his dead body was recovered. During investigation, Narendra Singh @ Fantoosh was arrested and gave his self inculpatry statement from which it appears that Narendra Singh @ Fantoosh had planned the killing of the

Patna High Court CR. MISC. No.11063 of 2026(3) dt.13-05-2026 2/3 deceased. The petitioner and Narendra Singh @ Fantoosh and others went to the house of the deceased and called him and thereafter, took him at a secluded place and e killed the deceased by strangulating him with a belt.

4. Learned counsel for the petitioner has submitted that the petitioner being in custody since 28.08.2024 has a right of speedy trial as till date, out of eight witnesses, only four have been examined.

5. Learned counsel for the informant has submitted that out of remaining four witnesses, one has died and one has met with an accident and they will not be examined by the prosecution and the remaining two witnesses i.e. the official witnesses are likely to be examined on the next date. He also submits that the informant will co-operate in the trial.

6. In view of the aforesaid, it appears that the trial is on the verge of completion.

7. Considering the aforesaid, this Court is not inclined to review its earlier order and accordingly, this application is dismissed.

8. The Superintendent of Police, Bhojpur is directed to produce the official witnesses in the trial on the dates fixed so that the same is not delayed any further.
