JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 326, 307 and 498A/34 of the Indian Penal Code.

The prosecution case is that the petitioner, being the second wife of the husband of the informant along, with the husband and parents of the informant poured kerosene oil and caused burn injuries to the informant.

It is submitted by learned counsel for the petitioner that the petitioner is the wife of informant's brother, though, she has been described as 'Sautan' in the FIR but this fact has not been admitted by the informant while opposing prayer for bail of her husband which gets reflected from the order passed in Cr. Misc. No. 43772 of 2015 whereby the husband of the informant has been

Patna High Court Cr.Misc. No.5789 of 2016 (2) dt.04-02-2016 2/2 granted provisional anticipatory bail on submission of both sides that they are ready to resume the conjugal right. There is no injury report on record and the accusation is omnibus and general. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bettiah, West Champaran in connection with Shikarpur P.S.
