The petitioner seeks bail in connection with NDPS Case No.-80 of 2023 registered for the offence under Sections 8, 20(ii)(b)(c) and 23 (c) of the NDPS Act. 3.

As per the prosecution case, it is a case of 3 kg. charas was recovered from the possession of the petitioner. 4.

Learned counsel appearing on behalf of the petitioner submits that petitioner has falsely been implicated in this case. He next submits that the petitioner is an old and widow lady and she is living alone in her house. Petitioner has got clean antecedent and she is in custody since 13.10.2023. 5.

Learned APP appearing for the State, op-

Patna High Court CR. MISC. No.14045 of 2024(2) dt.04-03-2024 2/2 poses the prayer for bail of the petitioner.

From perusal of the first information report, seizure list as well as impugned order dated 20.12.2023, it appears that the three kg. charas was recovered from the conscious possession of the petitioner and this more than commercial quantity, I am not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is hereby rejected.
