JUSTICE ASHUTOSH KUMAR ORAL ORDER 25-02-2019 The petitioners seek bail in anticipation of their arrest in connection with CIS No. 1163/2018/Nabinagar P.S. Case No. 335 of 2018 dated 28.11.2018 instituted for the offences under Section 30(A) of the Bihar Prohibition & Excise Act, 2016.

Though there has been a recovery of fifty litres of liquor from the ancestral house of the petitioners but the petitioners have, for a long time, been residing in Noida where they are gainfully employed.

It has been submitted that in the absence of the petitioners, the ancestral house has been used by somebody for storing the liquor.

No.11188 of 2019(2) dt.25-02-2019 2/2 Regard being had to the aforesaid facts and taking into account the clean antecedents of the petitioners, the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VII-cumSpecial Judge(Excise), Aurangabad in connection with CIS No. 1163/2018/Nabinagar P.S. Case No. 335 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
