The petitioners apprehend their arrest in Deedarganj P.S. Case No. 118 of 2012, registered for the offences punishable under Sections 420 and other Sections of the Indian Penal Code. The gist of the allegation is that the petitioner Shyam Sharma impersonated himself to be Sri Ram Singh and Geeta Devi wife of the petitioner impersonated herself to be wife of Sri Ram Singh. They took Rs. 15,01,000/-, but did not execute the sale deed.
Learned counsel for the petitioners submits that the petitioners never executed any deed of agreement to sale nor received any money from the informant. The informant had filed a case before the Sub Registrar for a direction to the petitioners to
Patna High Court Cr.Misc. No.5760 of 2015 (2) dt.12-02-2015 2/2 execute the sale deed and the same was rejected. Geeta Devi the wife of petitioner no. 1 has already been granted anticipatory bail vide orders passed in Cr. Misc. No. 50458 of 2013. Considering the facts aforesaid and the fact that the dispute appears to be of civil nature, the petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Patna City in connection with Deedarganj P.S. Case No. 118 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
