The petitioner seeks bail in connection with Ishakchak P.S. Case No. 146 of 2019, registered under Sections 504, 506, 385, 386 and 34 of the Indian Penal Code and 27 of the Arms Act.

The accusation is that Kanhaiya Thakur, Asutosh Kumar, Ajay Yadav (petitioner) and Deepak Sah came at the gumti shop of the informant, Pramod Kumar Sah, and took the cigarette, but, on demand of price of cigarette they started to abuse and moved from there giving threatening. On next day, i.e., 16.09.2019 in the night at about 10.30 p.m., petitioner, along with one Ajay Kumar Yadav, came at the shop and made demand of ransom of Rs.25,000/-, when informant made protest, then, they also made fire.

No.9739 of 2020(2) dt.28-02-2020 2/2 Submission is that in fact, the petitioner had given cash of Rs.25,000/- to the informant, Pramod Kumar Sah, for running the gumti and after some time when the petitioner made demand of money, then, with ulterior motive the informant lodged the present case. Further, submission is that the petitioner is in custody since 18.11.2019.

Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Ishakchak P.S. Case No. 146 of 2019 to the satisfaction of the Chief Judicial Magistrate, Bhagalpur.
