The petitioner seeks bail in Barhat P.S. Case No. 17 of 2021, registered for the offence punishable under Section 420 and other allied sections of the Indian Penal Code. As per the prosecution case, when the petitioner was apprehended in connection with Barhat PS Case No. 110 of 2018, on search, one Samsung mobile bearing no. 7258807715 and another mobile bearing 7320873987 were seized. During investigation, it has come that mobile no. 7258807715 belongs to one Juhi Parween, but she in her affidavit stated that she never purchased or used the said mobile number. It is alleged that the said number was being used by the petitioner for naxal activities.
It is submitted on behalf of the petitioner that no
Patna High Court CR. MISC. No.12317 of 2022(2) dt.09-05-2022 2/2 mobile phone was recovered from possession of this petitioner and only with a view to implicate this petitioner recovery of mobile has been shown from possession of this petitioner. Petitioner is in custody since 12.02.2021. Investigation is complete.
Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Jamui in connection with Barhat P.S. Case No. 17 of 2021.
