2. The petitioner seeks bail in connection with Harsidhi PS Case No. 611 of 2023 instituted for the offences punishable under Sections 341, 323, 307, 354(B), 379, 504, 506 and 34 of the Indian Penal Code.

3. As per the prosecution case, all the accused persons including the petitioner assaulted the informant with fists, slap and iron rod.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has falsely been implicated in this case due to land dispute. He further submits that there is case and counter case attributed

Patna High Court CR. MISC. No.18163 of 2024(2) dt.14-03-2024 2/2 between the parties. Both are family members and there is land dispute between the parties. Petitioner has got clean antecedent as stated in para 3 of the petitioner and is in custody since 08.01.2024.

5. Learned APP opposes the prayer for bail.

From perusal of the FIR and impugned order of the learned Sessions Judge, East Champaran, Motihari dated 25.01.2024, it appears that petitioner is named in the FIR and the allegations against the petitioner is that he assaulted the informant with fists and slap. Both the parties are pattidars and there is case and counter case attributed between the parties and entire family members have been made accused, accordingly the prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Harsidhi PS Case No. 611 of 2023.
