1. Heard learned counsel for the petitioner and learned A.P.P. for the State, Mr. Rabindra Kumar.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 325, 337, 307, 353, 379, 427, 411 and 504 of the Indian Penal Code.

3. Learned counsel for the petitioner submits that petitioner has antecedent of one case.

4. The informant alleges that a raid was conducted and a tractor loaded with 100 CFT of sand was apprehended, further four ditches were also found at the place of occurrence from which sand was excavated, it is next alleged that on account of illegal sand mining, the government lost Rs. 11,07,250/- by way of revenue, it is further alleged that when

No.24784 of 2024(2) dt.24-07-2024 2/3 the tractor was being seized, the miscreants arrived and damaged the government vehicle and also pelted stones causing injury to Mines Inspector, further Shlok and Murari were arrested who disclosed the name of the other accused persons including the petitioner.

Learned counsel for the petitioner submits that petitioner has no concern with the seized tractor and his name transpired in the confessional statement of apprehended accused in police custody, further the allegation of assault and pelting stone is general and omnibus in nature. It is next submitted that petitioner is not the owner of the seized tractor nor is involved in sand mining.

6. Learned A.P.P. for the State, Mr. Rabindra Kumar, opposes the prayer for anticipatory bail of the petitioner.

7. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Nagar (Kadirganj
