JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-02-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Section 365/34 of the Indian Penal Code.
The prosecution case is that the son of the informant, Manjeet Mandal, left his house on 11.11.2014 and informed his inlaws house that he was coming to take meal but he neither reached to the in-laws house nor returned home leading to registration of FIR against unknown. After five months of the registration of the FIR suspicion has been raised against in-laws family including Renu Devi, wife of the victim.
Petitioner No.1 is Samdhi of father-in-law of victim, petitioner No.2 is sister-in-law of the victim, petitioners Nos. 3, 4
Patna High Court Cr.Misc. No.7244 of 2016 (2) dt.18-02-2016 2/2 are father-in-law and mother-in-law of the victim and petitioner No.5 is wife of the victim.
It is submitted by the learned counsel for the petitioners that only suspicion has been raised against the petitioners and since the son of the informant has performed second marriage, in order to save his skin, this frivolous case has been lodged. Considering that suspicion raised after five months of lodging of the FIR similarly situated accused Anil Kumar has been granted anticipatory bail by learned 3rd Additional Sessions Judge, Madhubani.
Considering the aforesaid facts and the fact that only suspicion has been raised against the petitioners after five months of the occurrence, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM, 1st class, Jhanjharpur in connection with Laukahi P.S. Case No. 161 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
