1. Ms. Sakshi Bhatnagar, learned Advocate for the appellant presses I.A. No. 01 of 2024, for condoning the delay of three months and five days in preferring this appeal.

Re: LPA No. 132 of 2024 Heard Ms. Sakshi Bhatnagar, learned Advocate for the appellant and Mr. Ravi Kumar, learned AC to AAG13 for the State.

2. The appellant, a contractual employee, was terminated from service as it was found out that he had given false date of his birth. The matter was verified and it was found that the actual date of birth of the appellant was 02.07.1953, but he appeared in the examination by showing his date of birth as 02.07.1972.

3. The contention of the appellant that he was not noticed before termination is not correct factually. A show-cause notice was issued to the appellant which he replied and which was not found to be correct.

4. Taking this into account, we do not find any reason to interfere with the order passed by the learned

Patna High Court L.P.A No.132 of 2024 dt.19-02-2025 3/3 Single Judge.

5. The appeal is without merits and is thus dismissed.
