JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-02-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 40 of the Minor Mineral Concession Rules, 1972, Section 7 of the Bihar Minerals Prevention of Illegal Mining Transportation and Storage Rules, 2003 and Sections 406 and 379 of the Indian Penal Code. It is alleged that the petitioner lifted sand illegally from Jogiyahi river bed.

Learned counsel for the petitioner submitted that from perusal of alleged challan it appears that it was issued by one Ram Bilash Yadav and as per own admission of the informant Ashok Yadav along with others were carrying sand but they were not made accused.

In view of nature of allegation, let learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Kumarkhand P.S.case No. 68 of 2014 pending in the court of learned C.J.M., Madhepura. With the aforesaid observation this application stands disposed of.
