Mr.Ajay Mishra ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-11-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 406, 409, 420 of the Indian Penal Code.

The FIR has been instituted on the basis of written application of Kumar Gunanand Singh, Block Education Officer, Kumarkhand, Madhepura alleging therein that this petitioner, who was Panchayat Teacher of Primary School, Rehta, Ramnagar withdrew Rs. 13, 45, 594/- fraudulently through Government exchequer.

Learned counsel appearing for the petitioner submits that petitioner has committed no offence and has falsely been implicated in the case. Entire allegation against the petitioner is

Patna High Court CR. MISC. No.12616 of 2022(6) dt.01-11-2022 2/2 based on conjecture and surmises. During the course of enquiry it has come that alleged amount deposited in the account of this petitioner has already been transferred to the Officer concerned by cheque on 30.03.2021. Petitioner has got clean antecedent. Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st class, Madhepura in connection with Srinagar PS case No.16/ 2021, subject to conditions laid down u/s 438(2) of the Cr. P. C. (Prabhat Kumar Singh, J) BKS/- U T
