The petitioner seeks bail in Pandaul P.S. Case No. 204/2018, G.R. No. 1837/2018, instituted for offences under Section(s) 272, 273, 406 and 420/34 of the Indian Penal Code read with Sections 30(a), 36, 38(i) and 41(i) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner has submitted that recovery has been made from a truck in front of Poultry Farm of Manoj Singh. There is no recovery of any illicit liquor from the conscious possession of this petitioner. He has been arrested in this case merely on suspicion.

The other co-accused, who was arrested along with this petitioner under suspicion, has already been granted bail by

Patna High Court CR. MISC. No.11102 of 2019(2) dt.26-02-2019 2/2 this Court in Cr. Misc. No. 7168/2019 dated 07.02.2019. Petitioner is in custody since 19.11.2018 having clean antecedent.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. District & Sessions Judge-cum-Special Judge, Excise Act, Madhubani, in connection with Pandaul P.S. Case No. 204/2018, G.R. No. 1837/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
