JUSTICE SANJAY PRIYA ORAL ORDER 07-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Karamchat P.S. Case No. 01/2017 instituted for the offence under sections 7 of the Essential Commodities Act.
It is alleged that seven bags of rice of mid-day meal was being taken by this petitioner on a tractor for black marketing. The tractor with driver was apprehended and handed over to the police by the informant.
It is alleged on behalf of the petitioner that he was distributing the rice of mid-day meal in different schools and no black marketing was done by this petitioner.
In this respect, the informant has filed, Annexure-2, stating therein that truck number has wrongly been mentioned.
Patna High Court Cr.Misc. No.9573 of 2017 (2) dt.07-03-2017 2/2 It is clear from the written report itself that no any complaint was made by the school authority or any student that rice of mid-day meal of the school was being taken by this petitioner for black marketing.
It is mentioned in para-3 that the petitioner has no criminal antecedent.
Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner named above, within six weeks from today, in connection with Karamchat P.S. Case No.01/2017, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sub-divisional Judicial Magistrate-VII, Bhabhua, Kaimur, subject to the conditions as laid down under Section 438(2) Cr.P.C (Sanjay Priya, J) Ravi/- U T
