JUSTICE SANJAY PRIYA ORAL ORDER 16-05-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The Petitioners seek bail in Karja P.S. Case No. 122 of 2016 instituted for the offence under Section(s) 323,354A, 504/34 of the Indian Penal Code and 8/12 of the POSCO Act. It is alleged in the written report that when the daughter of the informant Sarita Kumari entered in the class room she found one Sonu Kumar in compromising position with a girl studying in Class 4. Thereafter, both gave threat to the daughter of the informant. Then the victim came to her house and told to her parent the story. The informant went to the school to lodge complaint. Thereafter, in retaliation, on the date of occurrence
Patna High Court Cr.Misc. No.21686 of 2017 (2) dt.16-05-2017 2/2 accused Arvind Kumar arrived at the house of the informant and took her daughter with him. Thereafter, the accused persons assaulted the daughter of the informant and when the informant went there to rescue her daughter the accused persons also abused and assaulted her then the informant, with the help of witnesses brought her daughter to her house in injured condition. Learned counsel for the petitioner submits that both these petitioners are brother of accused Arvind Kumar. From the written report it appears that there is no any allegation of specific overt act alleged against these petitioners.
In the facts and circumstances of the case, let the Petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Special Judge, Posco in connection with Karja P.S. Case No. 122 of 2016 subject to the conditions that both the bailors shall be the close relative of the petitioner.
