JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
The petitioner has been summoned in exercise of jurisdiction under Section 319 Cr. P.C. on 10.09.2014. Though, the petitioner was named in the FIR but he was not sent up for trial.
Considering the fact that the accusation was not found true during investigation but on the basis of evidence of P.Ws., 3, 4 and 5 during trial of co-accused, the petitioner has been summoned, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on
Patna High Court Cr.Misc. No.6137 of 2015 (2) dt.16-02-2015 2/2 furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge-V, Vaishali at Hajipur in connection with Jurawanpur P.S. Case No. 20 of 2010, subject to the conditions as laid down under Section 438(2) Cr.P.C.
The learned court below will be at liberty to cancel the bail bonds of the petitioner if he defaults for two consecutive occasions.
