The petitioner seeks bail in Kotwali (Barari) P.S. case No. 609 of 2016 under Section 307/34 of the Indian Penal Code and under Section 27 of the Arms Act.

The informant alleged that on account of displacing she-goat some altercation took place between petitioner, along with other accused persons, and Tinku Yadav and Rinku Yadav. On the order of Bharat Yadav the petitioner is alleged to have fired on Rinku and Tinku but the shot hit the informant, Pankaj Yadav, on his waist.

The learned counsel for the petitioner submits that injury found on the person of Pankaj Yadav is opined to be simple

Patna High Court Cr.Misc. No.18763 of 2017 (3) dt.17-05-2017 2/2 in nature. The petitioner is in jail since 30.11.2016. The petitioner has already remained in jail for more than five months. Considering the facts that on account of firing made by the petitioner simple injury is caused to the informant and for that the petitioner has remained in jail for more than five months, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in Kotwali (Barari) P.S. Case No. 609 of 2016 (G.R. No. 3793 of 2016).
