2. The petitioners apprehend their arrest for the alleged offences under Sections 147, 323, 354, 504, 506, 379 and 302 of the Indian Penal Code registered in connection with Turkaulia (Banjaria) P.S. Case No. 93 of 2014.
3. It is submitted that the petitioners have been falsely implicated as the informant's father died four days after the alleged occurrence, that too without any medical treatment.
4. Perused the case diary with the assistance of
Patna High Court Cr.Misc. No.15392 of 2015 (3) dt.26-08-2015 learned APP. Para 35 refers to the post mortem report and according to which the death occurred due to obstructive Lungs disease and Tuberculosis of Lungs.
5. Having regard to the entirety of the facts and circumstances, in the event of the petitioners arrest or surrender before the court below within six weeks from the date of communication of this order, let the above named petitioners be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari (East Champaran), in connection with Turkaulia (Banjaria) P.S. Case No. 93 of 2014, subject to the conditions as laid down under Section 438 (2) Cr.P.C. (Vikash Jain, J) Chandran U T
