The petitioner is accused in connection with Delha P.S. Case No. 218 of 2016, registered under Section 363 and 366 (A) and 34 of the Indian Penal Code.
The accusation is of kidnapping of the minor daughter of the informant by this petitioner along with Chanchla Devi and Ajeet Gosain.
Learned counsel for the petitioner submits that, in fact, there was love affairs in between petitioner an the daughter of the informant and accordingly, the daughter of the informant left her parental house according to her sweet will. Further submission is that the victim in her statement recorded under Section 164 Cr.P.C. has also stated about leaving of her parental
Patna High Court Cr.Misc. No.8231 of 2017 (2) dt.10-03-2017 2/2 house according to her sweet will due to love affairs with the petitioner and she also refused to go with her parents. In her medical examination, the age of the victim has been assessed above 19 years.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the ACJM-VII, Gaya in connection with Delha P.S. Case No. 218 of 2016.
