JUSTICE MOHIT KUMAR SHAH ORAL ORDER 24-05-2023 Heard the learned counsel for the petitioner and the learned A.P.P. for the State. The petitioner apprehends his arrest in connection with Banka Mahila P.S. Case No. 50 of 2015 registered for the offences punishable under Sections 448, 354(B), 323, 504 and 506 of the Indian Penal Code.

At the outset, the learned A.P.P. for the State has pointed out that since the present F.I.R. is of the year 2015 and the petitioner has already been granted the privilege of Section 41(1) Cr.P.C. by the Police, he is not having any apprehension since till date neither the said privilege has been cancelled nor he has been arrested.

No.16119 of 2023(3) dt.24-05-2023 2/2 In such view of the matter, the learned counsel for the petitioner seeks not to press the present petition, however, seeks liberty on behalf of the petitioner to again approach the learned Trial Court in case need so arises. Liberty so sought is granted.

The petition stands disposed off as not pressed.
