1. Heard learned Counsel for the petitioners as well as the informant and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Majhauliya Police Station Case No. 507 of 2025, disclosing offences under Sections 190, 191(2), 191(3), 126(2), 115(2), 303(2), 74, 109(1), 324(2), 308(4) of the BNS.

3. As per the prosecution case, on 29.07.2025, at about at about 11:00 am, while the informant was going towards her parental house from her matrimonial house, with her son on

Co-accused persons assaulted the informant on her head with iron rod and the petitioner nos. 1, 2 and 3 caught hold her hair and pulled her on the ground, due to which she sustained injury on her knees. It has further been alleged that petitioner no. 4 along with coaccused persons, assaulted son of the informant by sword and iron rod.

4. Learned Counsel for the petitioners submits that the petitioners have falsely been implicated in the present case. He further submits that both the parties are co-villagers and there is previous dispute between them. Case and counter case have been lodged and petitioners' side has lodged Majhauliya P.S. Case No. 502 of 2025 against the informant and her family members. It has further been submitted that both the sides have sustained injuries but injuries sustained by petitioners' side are grievous in nature whereas informant and her son have sustained simple injuries.

5. Learned counsel for the informant vehemently opposed the prayer for anticipatory bail of the petitioners and submitted that there is specific allegation against the petitioners that they assaulted the informant and her son and both have received injuries, though the same are simple in nature.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that there is case and counter case between the parties, both sides have sustained injuries and the injuries sustained by informant's side are simple in nature, I am inclined to grant the petitioners privilege of anticipatory bail.

7. This application is, accordingly, allowed.

8. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Bettiah, West Champaran, in connection with Majhauliya Police Station Case No. 507 of 2025, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure/Section 482(2) of the BNSS, 2023.
