The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code.

On theft being committed of a tablet (mobile) from the train the FIR was lodged against unknown. Subsequently, it is found that said tablet for some period sim registered in the name of the petitioner was used. It is submitted by learned counsel for the petitioner that the petitioner was not knowing that the tablet is stolen one and a statement has been made in paragraph 3 of the

Patna High Court Cr.Misc. No.6242 of 2016 (2) dt.09-02-2016 2/2 petition that the petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Bhagalpur GRPS P.S. Case No. 31 of 2015 pending in the court of learned Railway Judicial Magistrate, Bhagalpur.
