Petitioner is apprehending arrest in Muffasil P.S. Case No. 280 of 2021 registered for the offence under Sections 147, 148, 149, 341, 323, 333, 337, 338, 353, 504 of the Indian Penal Code.

It is alleged that the accused persons tried to get released the arrested accused from the custody of police and also blocked the National Highway.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against all the accused persons and no specific overt act has been alleged

Patna High Court CR. MISC. No.11580 of 2022(2) dt.16-08-2022 2/2 against the petitioner. Petitioner has got no criminal antecedent. Similarly situated co-accused has already been allowed bail by a co-ordinate bench of this Court vide order passed in Cr.Misc.No. 814/2022.

Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in Begusarai Muffasil Police Station Case No. 280 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
