JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 17-03-2016 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Rajoun Police Station Case No. 270 of 2015, disclosing offences under Sections 341, 323, 324, 307, 504, 506/34 of the Indian Penal Code.

Learned Counsel for the petitioners submits that the petitioners are ladies and thus, there is no likelihood that they will flee from the course of justice. It has further been submitted that there is specific allegation of assault against Munilal Singh, Bipin Kumar and Akhilesh Kumar and there is no such allegation against these petitioners. Petitioner no. 1 has been made accused because she is the wife of Munilal Singh and the petitioner no. 2 has been

Patna High Court Cr.Misc. No.7576 of 2016 (2) dt.17-03-2016 2/2 implicated in this case because she is the mother of coaccused, namely, Vikash Kumar. Considering the fact that there is no specific allegation of assault against these petitioners, who are ladies, this application is allowed.

Let the petitioners, namely, Sunaina Devi and Sushila Devi, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Rajoun Police Station Case No. 270 of 2015, subject to the condition laid down under Section 438

(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
