The petitioners are aggrieved by the order for grant of permit to some of the respondents by RTA, Muzaffarpur in meeting dated 31.01.2020. At the outset, learned counsel for the respondents counsel have pointed out that the petitioners had an alternative remedy under Sections 89 and 90 of the Motor Vehicles Act, 1988, for filing an appeal before the State Transport Appellate Tribunal. However, they did not exhaust this remedy. On due consideration of the matter, we are of the considered view that the petitioners ought to have exhausted the

Patna High Court CWJC No.3976 of 2020(2) dt.27-06-2022 3/3 alternative remedy available to him. On being asked, whether he is ready to do so even at this stage he has expressed his willingness.

Under the circumstances, this Court disposes off the writ petition with the direction that in case the petitioners files an appeal before the State Transport Appellate Tribunal within three weeks from today, the Appellate Tribunal shall not reject the same on the question of limitation alone. It shall consider the matter on merits and pass a speaking order at the earliest in any case not later than three months.
