JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 02-06-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Bariarpur P.S. Case No. 98/2014 registered under Sections 447, 341, 323 and 353/34 of the Indian Penal Code. The accusation is that the petitioner being a block teacher in the Middle school, Nirpur, assaulted the informant at the behest of co-teachers at the time of prayer of the student in the school. Learned counsel for the petitioner submits that that there is general and omnibus allegation against the petitioner and she has falsely been implicated in this case because of being a local teacher and the informant wants her transfer somewhere else. Learned counsel for the petitioner further submits the other

Patna High Court Cr.Misc. No.12944 of 2015 (2) dt.02-06-2015 P2/2 co-accused, namely, Suman Bharti, Kiran Devi and Anita Sinha and also Awadesh Kumar having similar allegations have already been granted bail by a bench of this Court vide order dated 04.03.2015 and 29.04.2015 passed in Cr. Misc. Nos. 8216 of 2015 and 16132 of 2015 respectively.

Considering the aforesaid submissions, let the above named petitioner be released on anticipatory bail, in the event of her arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Munger in connection with Bariarpur P.S. Case No. 98/2014, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Saif/- U T
