The petitioner has preferred this application for grant of regular bail in a case registered under sections 379, 356, 504 and 34 of the Indian Penal Code.

As per the prosecution case, the accused persons looted the informant on the point of pistol and took away his belongings.

It is submitted by learned counsel for the petitioner that the petitioner is not named in the first information report. His name transpired in the confessional statement of co-accused made before the police. No incriminating article has been recovered from his possession. He has been falsely implicated in the case because of his antecedent. He is in custody since

Patna High Court CR. MISC. No.22310 of 2021(2) dt.08-10-2021 2/2 16.1.2020 but has not been put on T.I. parade and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for over 1 year 8 months, the petitioner is directed to be enlarged on bail in connection with Katihar Town P.S. Case no. 583/2018 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar.
