Petitioner apprehends arrest in registered for the offences punishable under sections 30a/ 41 of the Bihar Prohibition and Excise Act.

As per the prosecution case, 561.600 liters foreign liquor was recovered from the truck of which petitioner is registered owner.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Petitioner claims clean antecedent.

Learned counsel for the State opposes the prayer for

Patna High Court CR. MISC. No.16746 of 2023(2) dt.23-06-2023 2/2 bail. He submits that petitioner is the owner of the vehicle from which there is recovery of illicit liquor, as such, he cannot escape responsibility.

Considering the aforesaid facts, prayer for bail of the petitioner is refused.
