JUSTICE SANJAY PRIYA ORAL ORDER 21-06-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Piri Bazar P.S. Case No. 61 of 2015 instituted for the offence under Sections-302, 201/120B of the Indian Penal Code.

It is alleged in the written report that the petitioner with other accused persons called the brother of the informant for work. The informant's brother went with them on the assurance of payment of due wages. It is further alleged that after 4-5 hours, a tempo was seen coming in the village and one dead body was thrown out from the tempo. The informant identified the dead body of his brother.

It is submitted on behalf of the petitioner that there is no specific allegation of overt act against the petitioner. The coaccused Sanjay Mandal and Chandan Singh have already been

Nos. 18861 of 2016 and 42707 of 2016 respectively. In such circumstances, the prayer for bail is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Piri Bazar P.S. Case No. 61 of 2015 to the satisfaction of learned Sub Divisional Judicial Magistrate, Lakhisarai subject to condition that both the bailors should be close relatives of the petitioner.
