JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-05-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends her arrest in a case registered for the offence punishable under sections 498(A), 304 (B), 34 of the Indian Penal Code.

It is a case of dowry death.

Petitioner is the nanad of the deceased.

Learned counsel for the petitioners submits that the petitioner is innocent and there is no specific allegation against the her. It is further submitted that the petitioners are separate in mess and business. Thrust of allegation is against the husband of the deceased who is already in custody.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks

Patna High Court CR. MISC. No.15540 of 2023(2) dt.18-05-2023 2/2 from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jehanabad in connection with Hulasganj P.S. Case No. 176 of 2021(Sessions Trial No. 257 of 2022), subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
