2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 399, 402, 414 and 120(B) of the Indian Penal Code and 25(1-b)a , 26 and 35 of Arms Act.
3. As per the prosecution case, there was a recovery of semi-automatic pistol loaded with six live cartridges along with a mobile from the possession of one co-accused Bablu singh who was apprehended on the spot who disclosed the name of this petitioner.
4. It is submitted on behalf of the petitioner that he has been made accused only in the basis of confessional statement of the co-accused person . No incriminating material
Patna High Court CR. MISC. No.14494 of 2024(3) dt.01-05-2024 2/2 has been recovered from the possession of the petitioner and he is no way connected with the alleged occurrence . Except confessional statement there is nothing on record to show the complicity of the petitioner in the present case .
5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate , Muzaffarpur in connection with Muzaffarpur P.S. case No. 429 of 2011 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
