The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 353, 414 of the Indian Penal Code, 11 (1) (a) and 11 (1) (k) of the Prevention of Cruelty to Animals Act.
It is alleged that the petitioners were carrying four animals to Nepal for smuggling and when intercepted by the informant being Dafadar then petitioners assaulted him.
It is submitted by the learned counsel for the petitioners that the petitioners being co-villagers of the informant were on inimical terms hence the present case
Patna High Court Cr.Misc. No.11607 of 2015 (2) dt.20-03-2015 has been lodged and the accusation has only been made on suspicion. The accusation does not constitute any offence under Sections 11(1) a and 11(1) K of the Prevention of Cruelty to Animal Act, 1960.
Considering the aforesaid facts, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Bettiah, West Champaran in connection with Bhangaha P.S. Case No. 01 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
