The petitioner has preferred this application for grant of regular bail in a case registered under sections 302 and 120B of the Indian Penal Code.
As per the prosecution case, while the informant along with his brother and security guards were returning after having visited the vacant plot near the training school, it is stated that four accused persons started to fire upon them which hit the informant's elder brother in his right hand. Further one of the shots fired hit the brother of the informant in his head. He subsequently died in course of treatment.
It is submitted by learned senior counsel appearing for the petitioner that the FIR was registered against unknown. The

No.22313 of 2021(3) dt.16-11-2021 2/2 name of the petitioner transpired in course of investigation in the confessional statement of co-accused Pankaj Kumar to the effect that the petitioner was involved in planning of the alleged occurrence. The said Pankaj Kumar has been enlarged on bail vide order dated 23.9.2020 passed in Cr. Misc. No. 25192 of 2020. The petitioner is in custody since 28.10.2020. Heard learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the facts of the case together with the material that has transpired in course of investigation and the petitioner having remained in custody for over one year, the petitioner is directed to be enlarged on bail in connection with Hajipur Sadar P.S. Case no. 427 of 2019 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali, Hajipur.
