The petitioner seeks regular bail in connection with Narpatganj P.S. Case No. 160/2016, registered for offences punishable under Sections 363 and 366A/34 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that it is a case of love affairs and the petitioner has falsely been implicated in this case at the instance of the father of the victim girl and the petitioner is in custody since 16.1.2017. Heard learned A.P.P. also. Learned A.P.P.
opposes the prayer for bail.
Having heard both sides and in view of the
Patna High Court Cr.Misc. No.16889 of 2017 (2) dt.08-04-2017 2/2 statement of the victim girl under Section 164 Cr. P. C. in which she has made certain allegations against the petitioner, I am not inclined to grant bail to the petitioner. The prayer is, accordingly, rejected.
However, considering the fact that the petitioner is in custody, the learned trial court is directed to expedite the commitment proceedings of the petitioner and the petitioner may renew his prayer for bail after the evidence of the girl is adduced before the Court.
Accordingly, this application is dismissed at this stage.
