Let the defect(s), if any, as pointed out by the office be removed within four weeks from the date of resumption of physical filing and physical removal of defect. In the present case, the petitioner seeks bail in connection with Pauthu P.S. Case No. 81 of 2021 registered for the alleged offences under Sections 384, 386 and 387 of the Indian Penal Code and Sections 18, 20 and 38 of Unlawful Activities (Prevention) Act, 1967.

The allegation against the petitioner is that they along with other co-accused persons demanded extortion money from the informant in the name of their organization. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.11667 of 2022(2) dt.04-07-2022 2/3 petitioner is innocent, he has been falsely implicated in this case and there is no specific allegation against the petitioner. The petitioner did not make any demand and neither he is member of the party in the name of which demand has been made. The petitioner has been apprehended at the instigation of the informant. The petitioner has no criminal antecedent and charge sheet has been submitted in this case. The petitioner is in custody since 24.12.2021.

Learned A.P.P. for the State has opposed the prayer for bail of the petitioner and submitting that the petitioner demand extortion in the name of his organization and he was apprehended from the spot by the villagers along with other coaccused persons. Having regard to the submissions made hereinabove and considering the fact that it is mostly general and omnibus allegation against the petitioner along with the period of custody of the petitioner, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Aurangabad (Bihar) in connection with Pauthu P.S. Case No. 81 of 2021, subject to the following conditions :

(ii) The petitioner will remain present on each and every date fixed by the court below.
