By way of the present application preferred under Articles 226 and 227 of the Constitution of India, the petitioner seeks quashing of the first information report in connection with Nauhatta P.S. Case No.50 of 2013 dated 5.11.2012 registered under Section 135 of the Indian Electricity Act, 2003. I have heard learned counsel for the petitioner and perused the allegations made in the FIR.
In view of the allegations made in the FIR, apparently, the ingredients of the offence punishable under Section
Patna High Court Cr. WJC No.320 of 2015 (2) dt.25-01-2016 2/2 135 of the Indian Electricity Act, 2003 are attracted in the present case.
Accordingly, the application, being devoid of any merit, is hereby dismissed.
