Petitioner seeks bail in connection with Barari (Sambhapur) P.S. Case No. 98 of 2019 registered for the offences punishable under Sections 302, 120/34 of the Indian Penal Code.

According to prosecution case, on 24.03.2019 brother of the informant was called by the co-accused persons upon which informant and his brother were going to met with them. All of a sudden the accused persons surrounded the brother of the informant and made firing causing death of informant's brother.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence and he has

Learned counsel further submits that there is no evidence regarding the involvement of the petitioner in the alleged crime. Allegation of firing is against co-accused persons. Petitioner is in custody since 20.10.2019.

The learned Additional Public Prosecutor opposed the prayer of bail.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-V, Katihar in connection with Barari (Sambhapur) P.S. Case No. 98 of 2019, subject to the following conditions:-

1. Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the court and on his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the Court below.

2. If the petitioner tampers with the
