JUSTICE SANJAY PRIYA ORAL ORDER 09-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Sadar P.S. Case No. 40 of 2017 instituted for the offence under Sections 457 and 379 of the Indian Penal Code.

The First Information Report is against unknown. It is alleged that laptop and other articles were stolen from the house of the informant.

It is mentioned in the impugned order that police arrested this petitioner from platform No. 2 of Purnea Railway Station and recovered laptop and other items, for which, petitioner could not give any reply. It is apparent from the impugned order that no TIP of those items have been made. Petitioner is in custody since 25.1.2017.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnia, in connection with Sadar P.S. Case no. 40 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioner.
