====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 13-09-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Let the defect(s), if any, be removed within a period of four weeks.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379, 354, 506/34 of the Indian Penal Code. The informant alleges that on 09.11.2021, his daughter was cleaning cow dung at the door when on account of land dispute, ten accused persons including the petitioner came and started abusing his daughter and assaulted her with slaps, it is next alleged that petitioner assaulted with farsa on head of the victim causing injury and tore her clothes and when the informant intervened, all the accused persons assaulted him with fist, stick and lathi, it is also alleged that Laxmi Yadav assaulted

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and has been falsely implicated in the present case, it is next submitted that on account of land dispute, the present occurrence took place, it is also submitted that the injuries suffered by the victim are simple in nature and a case from the side of the petitioner has also been filed being Babubarhi P.S. Case No. 261 of 2021 as such the present case is a counter blast to the said case in which from the side of the petitioner also injured and have suffered injuries. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Babubarhi P.S. Case No. 262 of 2021 subject to the conditions as laid down
